By using our website, you accept these terms and conditions, and agree to comply with them; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website. Additionally, you must be at least 18 years of age to use our website; by using our website or agreeing to these terms and conditions, you warrant to us that you are at least 18 years of age.

This section sets out the following terms and conditions when using and placing any order through this website, which will have the following meaning:

Use this Site only to place orders or make requests legally valid for your own personal purposes and non-comercial use.

All designs, content, materials, copyright and other intellectual property rights displayed on this website are reserved. All design rights are the sole property of Carlota Яojas. You may use such material only if we specifically authorise it or if you are granted a license for its use from us. This will not prevent you from using this website to the extent necessary to copy information about your order or contact information.
All goods you purchase in this website will be supplied by Carlota Яojas. To place an order to purchase goods displayed on this website, you need to follow onscreen prompts after clicking on the item you want to purchase. In the My Cart page, you will have the opportunity to check and correct any information or error in your order until you place your order. We will acknowledge receipt of your order by sending an automatically generated email. However, no binding contract will be formed between us unless we have accepted your order by sending a separate email confirming your order. With this email the contract will be concluded. The contract will relate only to those specific goods which are referred to in our confirming email. You should read and check all the details in the email are correct, in case they are not, please contact us at firstname.lastname@example.org.
All products displayed on this website are unique and exclusive, meaning no replicas will be made once a product is sold out. With respect to the colour of products, we try our best to display as accurately as possible the colours of our products that appear on this website. However, colours may slightly differ depending on your monitor, so we cannot guarantee that your monitor's display of any colour will be accurate.
All items are subject to availability. Because our products are unique and exclusive, we cannot guarantee permanent or continuous availability of all products on this website. In case a product is not available and may be ordered by error, we will cancel your order and inform you as soon as possible, offering alternative products if possible.
5. Price and Payment
We constantly try to ensure that all prices stated in this website are correct; however, occasionally there may be errors, so a product may be incorrectly priced. In the event, we find an error in the price of any product you have purchased, we will inform you as soon as possible. Then, we will give you the option to: (i) cancel your order and refund the price you have paid (including delivery costs) or (ii) ask you whether you want to continue with the order at the correct price. If we are unable to contact you, the order will be automatically cancelled and we will refund you the full price and delivery costs you have paid. Where the correct price of a product is less than our stated price, we may continue with your order and charge you the lower amount upon order confirmation before shipping the product.
All prices in this website are displayed in pounds Sterling inclusive of UK VAT. Prices do not include delivery costs, which will be added to the total at the checkout accordingly to the country of destination and delivery service. All payments are processed externally by PayPal. This is our preferred payment method as PayPal offers the safest internet payment tool and provides insurance and protection to both the seller and buyer. Your payment details will not be shared with Carlota Яojas at any moment. To make a payment it is not necessary to create a PayPal account, but only to introduce all the necessary details and personal information.
Please note that prices quoted on this website are subject to change by us without notice, but those on the site at the time of any order placed will be the prices applicable to that order. In addition, we reserve all rights to refuse service or cancel orders at any time.
6. Delivery and Costs
We deliver mainly within the United Kingdom via Royal Mail, and accept orders for delivery to Europe and worldwide, subject to customs, legal, regulatory and certain practical restrictions. We will deliver the goods ordered by you to the address you give us for delivery at the time of the payment. It is your responsibility to facilitate us the required information, and ensure this information is correct. If the information required is incorrect or incomplete we reserve the right to not ship your order and cancel it. Additionally, incorrect delivery address may cause delays for which we will not be liable.
The delivery cost for UK Standard shipping is £8 and it can take between 2-3 working days, unless Next Day Special Delivery is chosen which costs £12. Deliveries for Europe cost £12 and may take between 3-5 working days, excluding fascinators and other valuable goods as an exact quote will be given upon request. International delivery costs vary depending on the country of destination, for an exact quote you need to email to email@example.com. We offer free delivery for orders over £150 ONLY for UK. We can if needed, arrange a different courier service but this may add an extra cost. Any delivery costs and dates are approximate only.
All products on display in this website are handmade and ready-to-wear. Products which require customisation may take 1 week before being shipped. Then, normal delivery times would apply. Once payment is received and the order confirmed, we aim to ship all orders within 3 days.

7. Return and Refund Policy
You have the right to return any purchased goods within 14 working days from the date you received your order. You must send the goods back to us to our postal address (PO Box 532, Twickenham, TW1 9PY, UK). Where your order comprises multiple delivery shipments, the period for returning your goods begins on the day after you received the last shipment ordered by you. You will be responsible for any delivery charge for returning the goods. We regret that refunds cannot be applied to customised products. Remember you are responsible for taking care of the products while they are in your possession. We recommend that returned products are packed safely and a traceable service is used, so they are covered by adequate insurance to ensure the products reach us. We cannot be responsible for goods lost or damaged in transit.
Once we have confirmed the returned goods are in good condition we will proceed to make the refund. We will send you an email to notify you we have received your returned item and a refund will be made. Refunds are proceed in accordance with the original method of payment that was used for the purchase. We will issue a refund of all returned products including delivery costs within 3 days of receipt and subsequent confirmation. Please allow some days to see the refund is credited in your bank account.
In the event an item is found faulty or it has suffered any damage whilst in transit you can return it. You must notify us a faulty item by emailing us to firstname.lastname@example.org immediately (24h upon receipt of your order), providing us with the order reference and details about the fault or damage it has suffered. Cost of delivery will be reimbursed by us, as well as the cost of the goods once we have received the item and checked its condition. We will email you to inform you a refund can be proceed. This refund will be made in accordance to our refund process.
Carlota Яojas reserves the right to refuse any returned goods if they are not in a good condition or are returned after 14 working days.
8. Right to Cancel
If you are contracting as a consumer, you have the right to cancel your order without having to give a reason at any time before your goods are shipped or within 7 working days after you received you order. Where your order comprises multiple delivery shipments, the 7 working days cancellation period begins on the day after you received the last shipment ordered by you. To exercise your right to cancel, you must inform us of your decision as soon as possible to email@example.com. You must provide us with the order reference and name of the product(s). Then, you must return the goods to us to our contact address (PO Box 532, Twickenham, TW1 9PY, UK). Any product returned must be received by us in a good condition and same packaging as when we delivered them to you. You then have then further 14 working days to send the goods back in accordance to our return policy. We will notify you once we have received all the goods and checked their condition. In case the returned good is not in an unused condition or is returned after 14 working days we will not reimburse you what you have paid for the goods and their delivery. If the goods are in a good condition, you will receive a full refund of the price paid for the products including relevant delivery charges in accordance to our refund process.
Carlota Яojas reserves the right to refuse the cancellation and subsequent reimbursement of customised designs as the headpiece or accessory will already be in production.

9. Links to Other Web Sites
In the case this website contains links to external services or resources, including other websites or third party materials, these will have an informative effect without us having any control over them. As such links are provided as a convenience to you. Therefore, we cannot be responsible for any loss or damage derived from its use.
10. Limitation of Liability
In no case shall Carlota Яojas be liable for any claim related to loss or damage of any nature which is not foreseeable and arise from your use or access to this website and its contents. This includes (without limitation): (i) loss or corruption of any data, database or software; (ii) business losses, including (without limitation) loss of profits, income, revenue, savings, business opportunities, contracts, and any other similar losses; (iii) special, indirect or consequential loss or damage and (iv) loss or damage incurred as a result of the use of any content posted, transmitted, or otherwise made available via this website. Additionally, we do not warrant complete accuracy, reliability or uninterrupted service as errors and omissions of the information presented and dysfunction of this website may occur.
Nevertheless, nothing in these terms and conditions shall exclude or limit our liability for: (i) death or personal injury resulting from our negligence, (ii) fraud or fraudulent misrepresentation and (iii) any liabilities that is not permitted under applicable law or exclude any liabilities that may not be excluded under applicable law.
11. Events Beyond Our Control
We will not be responsible for any failure to comply, or any delay on compliance of any of our obligations under any contract that is caused by events beyond our reasonable control (Force Majeure Event). A Force Majeure Event include any act, event, omission or accident beyond our reasonable control. Among the following (without limitation): (i) strikes or other industrial action; (ii) civil commotion, riot, invasion, terrorist attack, war (whether declared or not) or threat or preparation for war; (iii) natural disasters; (iv) impossibility of the use of means of public or private transport; (v) impossibility of the use of public or private telecommunications networks and (vi) acts, decrees, legislation, regulations or restrictions of any government. It will be understood that any obligation is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.
In the event that any provision of these terms and conditions is determined by any court or other competent authority to be unlawful or unenforceable, the forceable provision will continue in effect permitted by applicable law. If the unenforceable portion shall be deleted, such determination shall not affect the validity and enforceability of any other remaining provisions.
Carlota Яojas reserves the right to revise, modify and update these terms and conditions, or any part of these, at any time and at our sole discretion. When we make changes or updates we will post them in this page. You will be subject to the applicable terms and conditions at the time you are using this website or placing an order. It it your responsibility to check this section from time to time to take notice of any changes. You will be able to check when was the last time these terms and conditions were revised by turning to the bottom of this page, where you will see “Last update” and the modified date. Your continued use of or access to our website following the posting of any changes to these Terms and Conditions of Use constitutes an agreement to be bound by those changes.
14. Law, Jurisdiction and Language
These terms and conditions shall be governed by and construed in accordance with the English law. Any dispute or claim arising from, or related to any contract for the purchase of goods from this website shall be subject to the non-exclusive jurisdiction of the courts of England.
